DOMA's Federal Definition of Marriage Unconstitutional, Judge Rules in Golinski Case

Today, the U.S. District Court for the Northern District of California issued its order finding that Section 3 of the Defense of Marriage Act -- the federal definition of marriage -- is unconstitutional in Golinski v. Office of Personnel Management, Karen Golinski's challenge to the denial of her request for equal health insurance benefits for her wife.

Golinski, a federal court employee, brought suit after her request was denied. She is represented by Lambda Legal Defense and Education Fund. Because President Obama and the Department of Justice have stopped defending Section 3 of DOMA in court challenges, the Bipartisan Legal Advisory Group -- led by House Republican leadership -- had opposed Golinski's request in court.

I prefer the option of Government getting the fuck out of the business of marriage and all the shite that comes with it, in whatever definition of the word people wish to use (involving people of course, not the more poetic marriage of ideas etc).

The equal protection clause of the 14th Amendment is probably the coolest bit of legislation ever written in the history of legislation. As a guiding principle, it transcends and obviates many of the more explicit and celebrated amendments and laws written before and after it.

In essence it says "Are you treating this person differently than you are treating everyone else without good cause? Yes? Then cut it the fuck out." Against something like that, systematic legal discrimination doesn't stand a chance in the long run. Ironically, the principle that may represent the single best advancement in human affairs since the discovery of fire is also at the core of what many social conservatives consider the continuing downfall of America.

Anyway, good for Golinski. May the great legal boa constrictor continue its crushing ways.
